Electronic Application for Exemption from the German Federal Pension Insurance
Employed members of a German medical association are (with only a few exceptions) required to be members of the German Federal Pension Insurance (mandatory coverage)—in addition to their membership in the Saxon Medical Pension Fund. To avoid having to pay double contributions, an exemption from the statutory pension insurance requirement is necessary. This page compiles the most important information regarding exemption from the German Federal Pension Insurance (DRV).
1. E-exemption is mandatory
Under Section 6(2) of the Social Security Code VI (SGB VI), as amended, electronic exemption is mandatory in order to expedite and simplify the application and processing of claims. This is because the rule still applies that an exemption from mandatory statutory pension insurance must be reapplied for each time an individual changes jobs.
2. Filling out the exemption application
The electronic application form is provided by “Datenservice für berufsständische Versorgungseinrichtungen GmbH” (DASBV). To apply, you must provide information about your employment status as well as your membership in the pension fund and the professional association. Please fill out the application carefully!
3. Receipt by the SÄV & DRV
Once submitted, the fully completed exemption application is considered legally valid upon receipt by us. As soon as the Saxon Medical Pension Fund has confirmed membership in the pension fund and the medical association, the application is forwarded to the German Federal Pension Insurance for review. Applicants will receive the decision regarding their exemption from the German Federal Pension Insurance in writing by mail. The Saxon Medical Pension Fund will be notified electronically.
Deadlines and Retroactive Effect
Exemption from the German Federal Pension Insurance (DRV) must be applied for via an online form within three months of starting employment. Only if this deadline is met can the exemption apply retroactively to the start of employment. If the application is submitted late, the exemption will take effect only from the date the application is received. Contributions to the DRV and the Saxon Medical Pension Fund (Versorgungswerk) must then be paid for the period prior to the exemption.
New Application When Changing Jobs
An exemption that has been granted does not apply across the board to all future activities, but only to a specifically designated activity with a particular employer. Therefore, if the employer or the nature of the activity changes, a new application for exemption is required.
Notice of Exemption
Exempt members pay us the same amount that would have been paid to the DRV if they were not exempt.
Please clarify with your employer
- whether you would like to authorize your employer to pay the total amount, including the employer’s contribution, directly to the Saxon Medical Pension Fund, or
- whether the employer contribution should be paid to you along with your salary. In this case, you pay the total contribution to us monthly.
No application is required for self-employed veterinarians and physicians
The application must be submitted only by (employed) veterinarians and physicians—no application for exemption is required for self-employment in a private practice or in the event of unemployment.
Refund
Has your employer already paid mandatory contributions to the German Pension Insurance (DRV) for the periods covered by the current exemption? If so, please coordinate with your employer to apply for a refund from the collection agency (health insurance fund) as soon as possible and forward the refunded contributions to us.
Status Determination Procedure
If there is any uncertainty regarding the classification of your employment status under social security law—that is, whether it should be classified as employment or self-employment—it is advisable to initiate a status determination procedure.
The application must be submitted within one month of starting employment. The German Federal Pension Insurance Fund (Deutsche Rentenversicherung Bund) has exclusive jurisdiction over this procedure. It is advisable to conduct the entire procedure in close coordination with the respective client or contractual partner.
